Supreme Court

The Supreme Court was intended to be our Nations Intellectual Oligarchy.

It was intended to be apolitical.  The rulings on Gun Control, Abortion and the environment have made it clear that they are now a political arm of the extreme right. They are a real threat to our democracy.

Something similar occurred in the 30’s and Roosevelt could not get any of his Laws through because the Supreme Court rejected them. Franklin Roosevelt threatened to pack the court to 15 and as a result one of the justices switched their vote and all his laws passed to avoid having Roosevelt from packing the court.  Either Kavanaugh moves to the left or we need to pack the court. The problem with that solution is the Republican party will do the same when they get in. This is one of the reasons why we need a third party. If we can get 10% to 20% of the Senators and Congressmen elected to the third party the Republican Party will not be able to get control of Congress so they will not able to pack the court.

A possible solution would be to give the justices a raise to $1,000,000 per year but require that they:

  1. Agree to a set of rules of Conduct that will be drafted by the Judiciary committee (or better from  the apolitical department that I would like to created to draft laws)
  2. This will include the option to file appeals under certain circumstances to the Court of Appeals. I believe the majority of the Supreme Court justices will agree to this for the raise. I am not sure if I am right as to whether this idea is legally sound.
    1. I would like attorneys who file a lawsuit in the Supreme Court to have the right to appeal to the Court of Appeals if:
      1. They feel that a Supreme Court Justice has a conflict of interest.
      1. The Senate’s judiciary committee can refer complaints against a justice to the Justice Department who will decide if the complaint warrants filing charges against the Supreme Court with the Court of Appeals.
    1.  If they do not agree to the Rules of Conduct that Congress passes, then Congress should not fund the Supreme Court.
